Types of Applications for Design Registration
Standard Application
This is a straightforward application where no claim of priority is made.
The design is filed directly in India without referring to any previous filing in another country.
Reciprocity Application
This application claims priority based on a prior filing in a convention country (a country that has an agreement with India).
It must be filed in India within six months of the initial filing date in the convention country.
Note: The six-month period is strict and cannot be extended.

Documents Required for Design Registration Application
Form 1
Must be completed as per the specified format in Schedule-II of the Designs Rules.
Representations
Prepared according to Rules 12, 13, and 14 of The Designs Rules.
Must be submitted in two copies.
Form 21 (Power of Authority/General Power of Authority)
Required if filing through a patent agent or advocate.
Must be submitted in original form as per Schedule-II.
If a copy of the General Power of Authority (GPA) is submitted, it must be marked with the design application number corresponding to the original GPA submission.
Form 24 (Claiming Small Entity Status)
Must be completed in the prescribed format as per Schedule-II.
For Indian entities, this must be accompanied by proof of registration under the MSME Act, 2006.
For foreign entities, an affidavit as per Rule 42 of The Designs Rules signed by the applicant or authorized signatory is required.
Original Priority Document
To be submitted if claiming priority as per Rule 15 of The Designs Rules.
If the original document is not in English, an authenticated English translation must be provided.
Assignment Document
If the priority application applicant (from the convention country) differs from the Indian applicant, the original assignment document must be submitted to prove transfer of rights.

Complete Process for Design Registration in India
Filing the Design Registration Application
The applicant submits the design registration application along with required documents and fees to the Controller of Designs.
Referral to Design Examiner
The Controller of Designs refers the application to a Design Examiner to conduct a thorough examination for:
Formal compliance with the Designs Act, 2000 and Designs Rules, 2001
Eligibility of the design for registration as applied to the article
Formality Assessment by Examiner
The Examiner checks:Whether the application follows the prescribed format
Payment of the required fees
Applicant’s details: name, address, nationality
Address for service included in the application
Declaration of ownership is present
Representation sheets meet the requirements of Rule 14
Power of Attorney is submitted if required
Substantive Examination
The Examiner evaluates whether the design:Qualifies as a desirable design under the Act
Is new and original
Is not against public order or morality
Is not detrimental to India’s security
Review of Examiner’s Report by Controller
If the design passes the examination, the Controller approves registration immediately and issues the Design Registration Certificate to the applicant.
If objections arise or amendments are needed, a Statement of Objections is issued to the applicant.
Responding to Objections
The applicant must address the objections or request a hearing within 3 months from the objection notice date.
Failure to respond or request a hearing within this period leads to the withdrawal of the application.
Resolution Timeline
The objection resolution period should not exceed 6 months from the date of filing the application.
This period can be extended by 3 months if the applicant files a request in Form-18 within the initial 6 months.
